These Terms of Service ("Terms") govern your access to and use of the website and services operated by GIA Production ("GIA", "we", "us", or "our") at giaproduction.com.

By accessing our website or submitting an application, you agree to be bound by these Terms. If you do not agree, please do not use our services. If you have any questions, please contact us.

1. About GIA Production

GIA Production is a global creative agency providing talent management, film and video production, and digital marketing services, operating from studios in Dubai (UAE), Manila (Philippines), and Hyderabad (India).

2. Eligibility

• You must be at least 18 years old to use our services or submit a talent application.
• By using our services, you represent that you meet this age requirement.
• If you are acting on behalf of a company or agency, you represent that you have the authority to bind that entity to these Terms.

3. Talent Applications

3.1 Application process

Submitting an application at giaproduction.com/apply does not guarantee acceptance onto the GIA Production roster. All applications are reviewed by our team and acceptance is at our sole discretion.

3.2 Accuracy of information

You agree to provide accurate, current, and complete information in your application. You must not misrepresent your identity, measurements, age, or experience.

3.3 Photos you submit

• You confirm that you own or have full rights to submit all photos included in your application.
• Photos must feature only you. Do not submit images that include other individuals without their written consent.
• By submitting photos, you grant GIA Production a non-exclusive licence to use them for internal review, client matching, and (if accepted onto the roster) for portfolio presentation purposes.
• You may request removal of your photos at any time by contacting us.

3.4 Account creation

Upon submission, a GIA Production account is automatically created using the email address you provide. A sign-in link will be sent to that email. You are responsible for keeping your account secure. Do not share your sign-in links with others.

4. Agency & Partner Accounts

• Agency partnerships are established through a separate approval process. Submitting an enquiry does not guarantee a partnership.
• Approved agencies may manage talent profiles on behalf of talent they represent, subject to the talent's consent.
• Agencies must ensure that all talent they add have provided their informed consent for their profiles to be listed on the GIA Production platform.
• GIA Production reserves the right to suspend or terminate agency access for any breach of these Terms or conduct inconsistent with our values.

5. Client Services

• Clients engaging GIA Production for talent bookings, film production, or digital marketing services will be subject to separate project agreements and scopes of work.
• Enquiries submitted via the contact form are not binding commitments and do not create a contract until a formal agreement is signed.
• All project fees, payment terms, and deliverables will be specified in individual statements of work.

6. Intellectual Property

6.1 GIA Production content

All content on this website — including text, images, logos, design, and code — is the property of GIA Production or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

6.2 Your content

You retain ownership of any content you submit (applications, photos, messages). By submitting content, you grant GIA Production the rights described in Section 3.3 above. You represent that your content does not infringe the rights of any third party.

7. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent information.
• Impersonate any person or entity.
• Use our website for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to our systems or another user's account.
• Transmit spam, unsolicited messages, or malicious code.
• Scrape, copy, or redistribute our talent roster data without permission.
• Harass, threaten, or discriminate against any individual connected with GIA Production.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Disclaimers

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, GIA Production shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of data, or loss of business opportunities.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the greater of (a) the amount you paid GIA Production in the 12 months preceding the claim, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold harmless GIA Production, its affiliates, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your breach of these Terms or your use of our services.

12. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. GIA Production is not responsible for the content, privacy practices, or availability of any third-party sites.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates (UAE), without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

15. Termination

We reserve the right to suspend or terminate your access to our services at any time, for any reason, including breach of these Terms.
